Provision of information held by Northumbria Police made under the Freedom of Information Act 2000 (the 'Act')
Thank you for your email dated 15 December 2010 in which you made a request for access to certain information which may be held by Northumbria Police.
As you may be aware the purpose of the Act is to allow a general right of access to information held by a Public Authority (including the Police), subject to certain limitations and exemptions.
You asked:
With regards to the documents attached below entitled 'FOI 824-10 S Ladyman Letter', 'FOI 824-10 Cost Effectiveness of Cameras and VAS', and 'FOI 824-10 Speed Camera Damage to Road Safety'
"Please confirm from your records that you did receive the documents I identified above and the CD I sent with a covering letter to your Chief Constable.
Please copy to me all doccuments such as memos, minutes of meetings, notes of conversation,s emails, letters, proposals etc relating to these above documents and in particular the cost effectiveness of both cameras and signs.
Please copy to me in particular all documents of any kind relating to decisions to continue to use or recommend the use of speed cameras in defiance of clear evidence that vehicle activated signs provide at least as much benefit as cameras at a very small fraction of the cost.
Please copy whatever documentation is necessary to establish the financial involvement of your Force in Speed Awareness Courses or similar provided to drivers caught speeding. Please also advise the legal basis for such involvement."
In response:
We have now had the opportunity to fully consider your request and I provide a response for your attention.
1-2. Northumbria Police can neither confirm nor deny that it holds the information you have requested as the duty in s1(1)(a) of the Freedom of Information Act 2000 does not apply, by virtue of the following exemptions:
S40(5) Personal information
To confirm or deny whether the requested information is held would be unfair to the applicant. As disclosure would publish 'to the world' data in relation to the applicant.
You should consider this to be a refusal under section 17 of the Act.
No inference can be taken from this refusal that the information you have requested does or does not exist.
3. Please find attached below the report relating to the Northumbria Safer Roads Initiative (NSRI) nee Northumbria Safety Camera Partnership (NSCP) Trial for VAS.
4. Please find attached below the minutes from the Northumbria Police Authority - Resource Management Committee meeting of 1 April 2009 when financial matters relating to speed awareness were decided.
