Misconduct hearing for former PC Peter Miller

It is alleged that:

1. Between September 2020 and January 2021, during a period of training new recruits into the policing organisation, former PC Miller acted inappropriately and/or abused his position of a Student Trainer by engaging with student officers on a personal and private level, including:
   1. making inappropriate comments in person;
   2. messaging them over social media platforms to pursue contact which was inappropriate; and
   3. engaging in consensual sexual intercourse;

2. In December 2020, the public were expected to abide by laws designed to keep people safe and reduce the scale of fatalities. Specifically, The Health Protection (Coronavirus, Restrictions) (All Tiers) (England) Regulations 2020 came into force on 02/12/2020. At the relevant time, the Northeast, being the place former PC Miller lived and worked, was placed in the Tier 3 system. Tier 3 at the time meant: “No person may participate in a gathering in the Tier 3 area which consists of two or more people and takes place in a private dwelling or in any indoor space.” In December, former PC Miller and a student officer met and had consensual sex at former PC Miller’s home address. In doing so, former PC Miller breached the Tier 3 restrictions by meeting as two people in a private dwelling or indoor space.

It is alleged that the former PC Miller breached the following Standards of Professional Behaviour as set out in Schedule 2 of Police (Conduct) Regulations 2020:

• Authority, Respect and Courtesy
• Discreditable Conduct
• Orders and Instructions

The matter set out above, if proven, is said to amount to gross misconduct in that it is so serious as to justify dismissal.

If you wish to apply to attend the hearing, you must book no later than 1pm the previous working day.  This is to allow for sufficient time to progress the application.  Any requests received after this time will be unable to be processed in time for the hearing and therefore will be rejected. 

The identity of victims/witnesses may be protected during the hearing as appropriate.
